Summary of Reevaluation Changes by Document

Part A: General Project Identification and Description
2024 CE Reevaluation: Project limits of work, description, and purpose and need statement have been updated to include added scope of utility conduit installation on the Market Street bridge over Amtrak and I-76, two-way bicycle facilities on Market Street from Schuylkill Avenue West to 23rd Street, repairs on underside of span 1 of Chestnut Street bridge, modifying traffic lanes on Walnut Street to include parking protected bicycle lane, replacement of joints on Walnut Street bridge, deck resurfacing on Walnut Street bridge, roadway portions of Walnut Street will be milled and overlaid, repair of a floorbeam on Schuylkill Avenue West bridge over I-76, repairs to the Schuylkill River west bulkhead, repairs to JFK Staircase, replacement highway lighting over I-76 from Arch Street to Walnut Street and rehabilitation of a retaining wall on Market Street. Attachments have been updated to reflect current project limits and scope of work.

Part A: Engineering Information
2024 CE Reevaluation: Design exception removed based on current criteria and refinements in design. Traffic control measures updated for current construction schedule and trail impacts. Design criteria was updated based upon data from 2024. Detour exhibit updated. SR 0003 (Walnut Street) Design Criteria included.

Part A: Roadway(s)
2024 CE 2 Reevaluation: The bi-directional bike lane on Market Street and SR 0003 (Walnut Street) was added to the project scope since the approval of the 2020 CE Reevaluation.

Part A: Structure(s)
2024 CE Reevaluation: Minor changes were made for Structures 67-3010-0090-0376 or 67-3010-0090-0000 to reflect updates with current design plans. Updates for the East River Wall structure include added bulkhead repair at Chestnut Street (deferred from MPMS 17816 Project). Updates for Structure 67-0003-0090-2703 include: Scope modified to keep fill in place in span 2. Span 1 will repair brick and barrel deferred from MPMS 17816 Project. Updates for structure 67-3010-0080-0920 include: Added utility duct work on bridge spans 1-22 The scope for this structure includes superstructure replacement of Spans 22-24 (intersection of Market/Schuylkill Ave). Overall, the expanded scope of work since the 2020 CE Reevaluation approval now includes structures: BMS# 67-0003-0091-0607 (Walnut Street Bridge), West River Wall along the west bank of the Schuylkill River between Market Street & Walnut Street, 2400 Market Street Retaining Wall, JFK Boulevard Staircase over Schuylkill River Trail, and Market Street Retaining Wall (adjacent to CSX).

Part B: Section A-1
2024 CE Reevaluation: This section was updated to include accurate descriptions for impacts to the Schuylkill River waterway and its FEMA delineated floodway. Philadelphia Water Department comments have been incorporated into the E&S Plan. Updated correspondence with PADEP on consistency with Pennsylvania's Coastal Resources Management Program and Federal Coastal Zone Management Act has been attached.

Part B: Section A-2
2024 CE Reevaluation: the Parks & Recreational Facilities section was updated to include discussion of Key 93 funding for the Schuylkill River Trail and DCNR's non-conversion determination for the facility.

Part B: Section A-3
2024 CE Reevaluation: A PNDI Environmental Review conducted on March 14, 2024 (see attached copy of the PNDI Review Receipt below) indicated a potential impact with the PA Game Commission (PGC) and PA Fish and Boat Commission (PFBC). Correspondence from PGC dated March 15, 2024 stated that no impacts are anticipated from the proposed project. Correspondence from PFBC dated March 22, 2024 indicated that Northern Red-bellied Cooter (Threatened) and Shortnose Sturgeon (Endangered) are found in the vicinity of the project area. A list of PAFBC mitigation/minimization measures for all of the proposed project’s activities that might affect the Northern Red-bellied Cooter are provided in Section B: A-3 “Avoidance Measures to be Implemented.” PFBC deferred review for Shortnose Sturgeon to NOAA. NOAA provided a concurrence for the project via signature of the Verification Form. Responses from agencies are included in attachments.

Part B: Section A-4
2024 CE 2 Reevaluation: Resource Location Map was revised. 30th Street Railroad Station (Boundary Increase) (Resource #2023PR03199) was determined Not Eligible for listing in the National Register of Historic Places due to a lack of integrity and/or significance and was removed.

Part B: Section A-5
2024 CE 2 Reevaluation: The 30th Street Station (boundary increase) historic resource was determined not eligible for the National Register of Historic Places in December 2023; therefore, Section 4(f) no longer applies to the property. The TCE within the boundary of the 30th Street Station resource was determined not to be required for work at the intersection of Market Street and Schuylkill Avenue based upon coordination with Amtrak. Amtrak has agreed to provide PennDOT contractor access via a right-of-entry permit during construction; therefore, a Section 4(f) documentation is no longer required. All 4(f) documents were updated to reflect the current design plans.

Part B: Section A-6
2024 CE Reevaluation: No changes have been made to this section since the Evaluation document was approved in 2020.

Part B: Section A-7
2024 CE Reevaluation: The number of parcels impacted with permanent and temporary easements has been updated to reflect the recorded right-of-way plan since the Evaluation document was approved in 2020.

Part B: Section B
2024 CE Reevaluation: No changes have been made to this section since the Evaluation document was approved in 2020.

Part B: Section C
2024 CE Reevaluation: Project meetings with USACE and PADEP have been included, added meeting dates that have occurred since the 2020 Reevaluation.

Part B: Section D
2024 CE Reevaluation: Coast Guard Permit approval was granted. Several utilities will be supported by Market Street Bridge over the Schuylkill River, which will require the utility companies to apply for a General Permit 5 (GP-5) for the relocation/replacement of these lines. DEP Waterway Encroachment Permit (GP-11) and USACE Nationwide Permit 3 (NWP3) were issued for proposed waterway impacts on 08-14-2024 and 08-22-2024, respectively.

Part B: Section E
2024 CE Reevaluation: Threatened & Endangered Plants & Animals - Avoidance Measures (B:A-3) has been updated to reflect mitigation/ avoidance measures for potential impacts to T&E species. The Cultural Resources (B:A-4) section and Section 4(f) (B:A-5) section has been updated to include the updated mitigation measures.

Part B: Section F
2024 CE Reevaluations: No changes have been made to this section since the Reevaluation document was approved in 2020.

Part C
2024 CE Reevaluations: No changes have been made to this section since the Reevaluation document was approved in 2020.
