Required as per 25 PA Administrative Code Chapter 105 for projects involving the construction, modification, or relocation of any dam, water obstruction or encroachment. "Encroachment" is defined as any structure or activity that in any manner changes, expands, or diminishes, the course, current, or cross-section of any watercourse, floodway, or body of water (including wetlands). Any activity that disturbs a watercourse, floodway or body of water (including wetlands) requires authorization from PA DEP. The PA DEP permit process will jointly initiate the Section 404 (Federal Clean Water Act) process. Dependent upon project specifics, separate authorization may be received from the U.S. Army Corps of Engineers. However, with the exception of projects covered under the statewide programmatic general permit (SPGP), these permits are issued independently.
