Extraordinary cases or emergency situations when the Department may request and the Federal Highway Administration (FHWA) may approve Federal participation in the early acquisition of a particular parcel or a limited number of particular parcels within the limits of a proposed transportation project for corridor preservation, access management, or other purposes prior to completion of processing of the Environmental Document are subject to the requirements set forth in Publication 378, Chapter 3.11.
The Department may also request FHWA agreement to provide reimbursement for advance acquisition of a parcel or a limited number of parcels to prevent imminent development and increased costs (Protective Buying), or to alleviate hardship to a property owner(s) on the preferred location (Hardship Acquisition) but only after (i) the Department has given official notice to the public that it has selected a particular location to be the preferred or recommended alignment for a proposed highway, or (ii) a public hearing has been held or an opportunity for such a hearing has been afforded. Further guidance is provided in Publication 378.
