Environmental Justice (Executive Order 12898) requires every federal agency to put procedures in place to  identify and address any disproportionately high and adverse human health or environmental effects of its programs, policies, and activities on minority populations and low-income populations.

Refer to Pub. 746 Project Level Environmental Justice: https://www.pa.gov/content/dam/copapwp-pagov/en/penndot/documents/public/pubsforms/publications/pub%20746.pdf

Section 2.1 of Pub. 746 includes a list of project types which are exempt from detailed project level EJ analysis.

Document EJ analysis in CE Part B, Section A-7.  Identify if the project is exempt from EJ analysis.  If the project is not exempt, determine if EJ populations are present and document how the determination was made.  If EJ populations are present, determine if the project will induce disproportionately high and adverse impacts to low income or minority populations and describe any mitigation proposed.  If the project will not have any disproportionately high and adverse impacts on EJ populations, check the box at the bottom of the section.  Detailed information on determining if EJ populations are present, determining impacts, and potential mitigation options is included in Pub. 746.
