In accordance with 23 CFR 771.117 (c), actions that qualify as an emergency repair under 23 USC 125 can be documented as a Level 1a CE under item #9:
The following actions for transportation facilities damaged by an incident resulting in an emergency declared by the Governor of the State and concurred in by the Secretary, or a disaster or emergency declared by the President pursuant to the Robert T. Stafford Act (42 U.S.C. 5121):
(i) Emergency repairs under 23 U.S.C. 125; and
(ii) The repair, reconstruction, restoration, retrofitting, or replacement of any road, highway, bridge, tunnel, or transit facility (such as a ferry dock or bus transfer station), including ancillary transportation facilities (such as pedestrian/bicycle paths and bike lanes), that is in operation or under construction when damaged and the action:
(A) Occurs within the existing right-of-way and in a manner that substantially conforms to the preexisting design, function, and location as the original (which may include upgrades to meet existing codes and standards as well as upgrades warranted to address conditions that have changed since the original construction); and
(B) Is commenced within a 2-year period beginning on the date of the declaration.
When creating a new package, on the Package Document Form, Type, asks if the project is being documented as an emergency project. If you select yes, additional questions must be answered regarding if there is a formal Emergency Declaration by either the President or the Governor and if the repairs are emergency or permanent.
A scoping document is not required for emergency projects. When creating the evaluation, select “Waived” and include in the explanation that the project meets the criteria for an emergency project.
Not all forms are required to be completed for Emergency Projects. Only the Package Document, Title Page, A:General Project Identification and Description, B:A-4: Cultural Resources, and C: CEE Approval Processing are required. Additional forms can be added as appropriate.
For emergency repairs, after generating the package, use the Add Appendix button to attach the Damage Inspection Report (DIR). Additional appendices can be added as needed. Refer to Help Item – Using the System – Add Appendix.
